Update 11.28.11: Aruba Prosecution to meet with judge on Monday to appeal his ruling to release Gary Giordano. Giordano is being held in the disappearance of his travel companion Robyn Gardner.
Below is my previous report. Check back for updates.
11.27.11 Orangjestad, Aruba]----Gary Giordano, the sole suspect in Robyn Gardner's disappearance, may be free as early as Tuesday for a Judge has ordered his release.
50 year old Giordano, held in an Aruban jail in connection with his travel companion's mysterious disappearance since August 5, may be coming home to Gaithersburg, Washington if the judge's ruling stands.
Prosecution has reportedly appealed the judge's decision to set their only suspect free but according to Aruban law, Giordano cannot be held any longer without solid evidence linking him to a crime.
Gardner has not been seen or heard from since August 2 after travelling to the Dutch Caribbean island for a 5 day vacation with Giordano, a businessman she reportedly met online a year ago.
After he was arrested trying to leave the island, Giordano told police that the 35 year old dental assistant from Maryland had disappeared during a snorkelling excursion.
Giordano did not report her disappearance to the police and video tape footage reportedly showed him acting suspiciously on the day that Gardner vanished without a trace.
Extensive search of the island has not uncovered sufficient clues to where she might be or what exactly happened to her on that day. Authorities say the search efforts was more recovery than rescue for they believe her to be dead.
Giordano also took out a $1.5 million travel insurance on Gardner, which he reportedly made inquiries into immediately following her disappearance.
Gardner is the second American woman to diappear without a trace on the island of Aruba. In 2005, 18 year old Natalee Holloway also vanished from the same beach while visiting the tropical tourist hotspot with classmates on a graduation trip. No one was prosecuted for her disappearance though 17 year old Joran Van der Sloot was the last person she was seen with.
Once a person of interest, he has never been charged.
He is currently behind bars for the murder of another young woman.

10.5.11, Orangjestad, Aruba]------Cadaver dogs were reportedly shipped in last weekend from the Netherlands to help search for the remains of Robyn Gardner, an American woman missing in Aruba since August 2.
The search for 35-year-old Gardner will be concentrated in Seroe Colorado, the southeastern part of the island.
Gardner, a dental assistant from Maryland, reportedly went on a five-day vacation to the Dutch Caribbean island with suspect Gary Giordano, whom she met online.
The 50-year-old businessman from Gaithersburg, Maryland, was arrested on August 5 in connection with her disappearance and has been behind bars since, even though he has not been officially charged with a crime.
Giordano told investigators that Gardner disappeared on a snorkeling trip, but her boyfriend said she would have never gone in the water because she was obsessed with maintaining perfect hair and makeup.
Aruban authorities have since released video tape which showed the suspect pacing suspiciously from his car and back while wearing several toupees. They also reportedly have "beyond pornographic" photographs of the missing woman on a camera confiscated from Giordano.
Earlier news reports say that the businessman had tried to collect on a $1.5 million travel insurance policy he had purchased on Gardner.
In other developments, Casey Anthony's lawyer, Jose Baez, has joined Giordano's defense team, reportedly recruited by the suspect's father.

Dogs Arrive In Aruba To Search For Robyn Gardner's Remains
9.13.11. Oranjestad, Aruba]----In new interesting developments, Casey Anthony's lawyer has reportedly joined the legal team of man held in connection with the disappearance of his travel companion in Aruba.
Jose Baez shot to celebrity status by defending and winning the murder case against 25-year-old Anthony in which she was charged with killing her 2-year-old daughter Caylee in Orange County, Florida.
Baez announced on Tuesday that he would be "helping" 50-year-old businessman Gary Giordano now held in an Aruba jail after being arrested early August for his companion's disappearance on the Dutch Caribbean island, reported CNN.
The suspect already has an Aruban lawyer, Michael Lopez, who said that local laws prevents Baez from ever arguing in court but will allow him to serve in a consulting capacity.
Baez was hired by the suspect's father, Frank Giordano reported the Associated Press.
Giordano's travel companion 35-year-old Robyn Gardener disappeared on August 2 after flying to Aruba with him for a 5 day vacation.
Aruban investigators believe her to be dead but no hard evidence was found to connect the suspect to a crime.
The Gaithersburg, Maryland businessman allegedly tried to collect a $1.5 million travel insurance he had taken out on the missing woman and police reportedly have video of him acting suspiciously on the day the dental assistant from Maryland disappeared.
They also have a camera confiscated from Giordano with alleged "beyond pornographic" pics of the missing Gardener.
Giordano told police that his companion disappeared after a snorkelling trip but her boyfriend said that was highly unlikely for Gardener was obsessive about perfect hair and make-up.
The two reportedly met online about a year ago and no one knows if they had met in person before the Aruba vacation.
Though Giordano is behind bars, he has not been charged with a crime.
